Property & Finance Mediation
Property & Finance Mediation is a quick and effective way of resolving disputes which arise from relationship breakdown. With the help of a qualified specialist Family Mediation Solicitor clients can achieve agreement on all issues in dispute.
It is very common on separation that decisions need to be made about the former family home. There may be numerous other financial matters which need to be considered. These can include: –
- Second homes
- Interest in business
- Bank accounts/Shares/ISAs/PEPs
The mediation process involves financial disclosure of all assets. Once full disclosure has been made options can be considered for how best to move forward.
Our Property & Finance Mediation Service
After contacting our service you will be offered a one to one initial assessment meeting. Mediation sessions are normally conducted with both clients present in the room. Occasionally mediation takes place with clients in separate rooms and this is something we would discuss with you at your assessment meeting. The sessions are structured to allow clients to be able to communicate effectively and negotiate an outcome which is satisfactory to both clients.
Once agreements have been reached we will draw up a summary of your financial position as well as a mediation agreement, also known as a Memorandum of Understanding. Mediation on property and finance issues is significantly quicker than using the court process. It is also significantly cheaper. Where agreement is reached and is converted into a document known as a consent order the Court only has minimal involvement in the whole process.
Our Family Mediators are trained and accredited by the Family Mediators Association and/or Resolution and are skilled at assisting clients communicate effectively to resolve all issues in dispute. Generally matters discussed in mediation are confidential which allows clients to discuss issues freely and openly.
