Surrogacy enables a couple to have a baby which is genetically related to them where this would not otherwise be possible. There would be arrangements for a surrogate mother to carry and give birth to the baby.

Surrogacy Law

Surrogacy in the UK is governed by two pieces of legislation. The first is the Surrogacy Arrangements Act 1985 which governs surrogacy arrangements. It states that surrogacy arrangements will not be enforceable in the UK by any party. The second is the Human Fertilisation and Embryology Act 2008 which governs issues such as the legal parenthood of the child, who holds parental responsibility for the child and who can make applications for parent orders.

We can help with your surrogacy matter by providing you with advice on how the law will apply to you and your family and assist you with the legal processes which need to be undertaken. We would not, however, be able to enter into negotiations about a surrogacy agreement as the law prevents us, and all UK solicitors, from doing this.
