Variation of Maintenance Orders

Maintenance Orders can be varied either upwards or downwards or discharged completely.  The Court uses the criteria referred to in section 25 of the Matrimonial Causes Act 1973. The most common event which is used to request the variation of maintenance is that one person has had a significant change in their circumstances.

These circumstances can either be a large increase in their salary, or they have come into an inheritance or alternatively, a person who has previously paid maintenance and has lost their job and is no longer able to pay the level of maintenance which they had previously been ordered to pay.
